Police Encounter App™ (powered by D.O.P.E.): Privacy Policy This privacy policy applies to the Police Encounter App™ mobile application (the “App”) and the website https://www.dopethemovement.com developed and operated by De-escalation and Remedial Training Center, LLC (“D.R.T.C., LLC,” “us,” “we,” or “our”). “D.R.T.C. LLC,” is committed to maintaining your confidence and trust as it relates to the privacy of your information. Please read below and learn how we collect, protect, use, and in limited circumstances, share your information as part of the App. The App allows you to record audio and videos of encounters with law enforcement and public officials, transmit your recordings to up to three Emergency contacts you choose (input in Emergency Contacts under Settings) and to a private server. By using the App, you acknowledge and agree to this privacy policy. If you do not agree to this privacy policy, please do not use the App.

1. Basic Subscription

The “Basic User” is an in-app upgrade purchase for $2.99 a year.

• How is this subscription useful? What are the Benefits? What are the Features of this plan? The “Basic User” has access to all the content (written and video) from www.dopethemovement.com, featured podcasts, Quick Tips for Traffic Stops, Quick Tips for Pedestrian Stops, E-books, the first three (3) Educational video modules “Know Your Rights/Know Your Laws/Police Encounters” of Level One and It additionally unlocks the next six (6) Educational videos. Upon successful completion of all tests associated with the educational modules the “Basic User” will be placed at “Silver Badge” status. The “Basic User” has access to the template to properly file a formal complaint on a law enforcement agent; shared either by email to law enforcement agency contacts or PDF copy to print.

The “Basic User” can access the “SOS – I’ve been stopped” function that notifies three emergency contacts (chosen by the user), letting the Emergency contacts know the user has been pulled over and shares the Geo-location of the stop. It launches the “Ear Witness” function that automatically audio records the encounter and additionally sends to chosen Emergency contacts and saves the audio recording to the app in the Audio Recording Library.

2. Pro Subscription

Level Three “Pro User” is an in-app upgrade purchase for $9.99 a year.

• How is this subscription useful? What are the Benefits? What are the Features of this plan? The “Pro User” has access to all the content (written and video) from www.dopethemovement.com, featured podcasts, Quick Tips for Traffic Stops, Quick Tips for Pedestrian Stops, E-books, the first three (3) Educational video modules (Know Your Rights/Know Your Laws/Police Encounters), the six (6) Educational videos of Level Two and the last three (3) Educational videos (plus three Bonus Educational videos covering hot topics). Upon successful completion of all tests associated with the educational modules the “Pro User” will be placed at “Gold Badge” status. The “Pro User” has access to the template to properly file a formal complaint on a law enforcement agent; shared either by email to law enforcement agency contacts or PDF copy to print.

The “Pro User” can access the “SOS – I’ve been stopped” function that notifies three emergency contacts (chosen by the user), letting the Emergency contacts know the user has been pulled over and shares the Geo-location of the stop. The “Pro User” can choose the “Ear Witness” function that audio records the encounter, sending to chosen Emergency contacts and saving the audio recording to the app in the Audio Recording Library. If the Audio Recording option is not manually chosen, the “Pro User” can select the secondary S.O.S. button to automatically launch the “Eye Witness” video function that automatically begins recording (each “Livestream”). These 20-minute “Livestream” recordings are also automatically sent to the user’s three (3) Emergency Contacts and saved on the private server. If the recording is interrupted it still saves to the private server and sends to contacts, in case a third party attempts to delete the recording. If the 20-minute “Livestream” ends the “Pro User” could chose the prompt to start a second 20-minute “Livestream” recording for longer encounters.

The “Pro User” automatically places you in a pool of invitees that become eligible to attend a national “Virtual Town Hall” quarterly meeting (on Google Meets) with 100 Pro Users and guest speakers. During the meeting time is allotted for several Pro User’s to present local issues with law enforcement which the staff and others share solutions for safe and strategic outcomes.

3. Information We Collect

We do not access, collect or retain any information, including cookies, device IDs, or activity information about your use of other applications, other than what is specifically set forth herein.

• Personal Information. We may collect Personal Information (name, address, email address and phone number) when you register to use the App, if you choose to provide it to us. Providing this information is optional.

• Video Recordings (“Livestreams”). When you use the video recording feature in the App, we collect that video, audio, and its associated data. It can be manually pushed to anyone on your Emergency Contact’s list or automatically shared during the secondary “SOS” feature.

• Formal Complaints/Incident Reports. We collect your written responses in Incident Reports you submit. This may include your Personal Information or the Personal Information of others you may provide. Geo-Location Information. We may collect your physical location at the time you used the video reporting feature but only if you have enabled your location in Settings or input your location in an Incident Report.

• Information About Your Device and Connection. Your IP address may be included in the transmission of any of the information described here to “D.R.T.C., LLC,” but we do not retain your IP address after processing that transmission.

4. How We Use the Information We Collect

We use the information we collect about and from you for the following purposes:

• Personal Information is used to track and save your Video and Formal Complaints/Incident Reports. You will not be routinely contacted about your Videos or Reports.

• Formal Complaints/Incident Reports are for your use and are not treated as requests for legal assistance or protected by the attorney-client privilege. Neither the App nor any of the materials in it are solicitations or offers by the “D.R.T.C., LLC,” to represent you. We cannot promise you that the information you provide will lead to any specific action on the part of the “D.R.T.C., LLC.” We WILL NOTuse the information you give us in Formal Complaint/Incident Reports for any of the following purposes: to further the purposes of the App, including as legislative testimony; in support of litigation; in communications with a city, state or federal agency; or to tell your story to the public, including through the media.

• Video Recordings are used to support your case, share with your Emergency Contacts and are stored within the app and on a private server for at least 30-days. We may review Video Recordings stored on the serverwhether or not they are accompanied by a Formal Complaint/Incident Report. Because Video Recordings are intended to contain documentary evidence rather than any communication, we do not treat Video Recordingsas confidential. Do not send or use the Video Recording feature to make video recordings of any communications you intend to be confidential. We will only share your video recordings with your three (3) Emergency Contacts. We WILL NOT share or disclose part or all of the Video Recordings saved to any person or organization, or directly to the general public, if not required to do so by judicial order or subpoena. These orders must be in writing.If we are required to disclose your Personal Information or that of your Emergency Contacts in response to a legal demand and we have information that enables us to contact you, we will do our best to provide you advance notice and offer you a copy of the legal request, unless we are prohibited from doing so by a valid court order.

Again, the video recording shall be stored up to thirty (30) days on the private server and if the request is made after that time period“D.R.T.C., LLC,” may be required to release the video recording stored by the user on the app under the same above requirements.

• Geo-Location Information is used to mark the location the user has been stopped or contacted by law enforcement during an encounter. If you input contacts in the Emergency Contacts section in Settings, a link to your Video Recording will be sent to those contacts when you submit a Video Recording; and we will provide them with your Geo-Location Information at the time you press the SOS button and submit the Video Recording. We will not provide them with any other information, including your Personal Information, or any information from your Formal Complaint/Incident Report or Video Report.

• Your IP Address is not retained by the “D.R.T.C., LLC.” Your IP address may be used for transferring the information you submit to us but we do not store or retain your IP address.

5. Sharing of Information

Except as described here, we will not provide any of your Personal Information to third parties without your specific consent. We may share non-Personal Information with third parties without your consent. We share the Personal Information we collect in the following circumstances:

• “D.R.T.C., LLC,” Parent Organization, Affiliated Organization (De-escalating Officer Patrol Encounters, LLC., etc.) and Affiliates. We may share your Personal Information, Geo-Location Information, Video Reports, and Incident Reports collected through the App with and between “D.R.T.C., LLC,” affiliates and “D.R.T.C., LLC,” but only for the uses set forth in Section 2 of this policy. We require that any “D.R.T.C., LLC,” entity that receives any information comply with this Privacy Policy and the terms of the App’s End User License Agreement.

• Third Parties Providing Services on Our Behalf. We may share information we collect with third parties that perform functions on our behalf such as service providers that host, maintain, support or otherwise assist us with the App. We only use service providers that agree not to use or disclose the information we collect, except at our direction or to comply with legal process.

• Emergency Contacts Information. If you input contact information in the Emergency Contacts section in Settings when you submit a Video Report, that Report and your Geo-Location Information will be shared with those contacts.

• Broader Public Disclosure and Associations. “D.R.T.C., LLC,” is not associated or connected to any law enforcement agency, political association, media outlet or government entity. We WILL NOT share any of your personal information, audio recording, video recording or record of any kind with the above-mentioned. Any information being shared by “D.R.T.C., LLC,” will be due to judicial order or subpoena only.

• Legal Disclosure. We may share information we collect, including Personal Information, Geo-Location Information, Video Reports or Incident Reports if compelled by law, regulation, or valid legal process. We will go to court to fight any demand that we do not believe is legitimate. “D.R.T.C., LLC,” takes your right to keep your Personal Information and that of your Emergency Contacts private from the government very seriously. If we are required to disclose your Personal Information or that of your Emergency Contacts in response to a legal demand and we have information that enables us to contact you, we will do our best to provide you advance notice and offer you a copy of the legal request, unless we are prohibited from doing so by a valid court order.

• Selling Information to Third Party. We DO NOT sell any of the Information we collect to any person, company or other third party.

6. Security of the Information

The information you submit through the App will be transmitted only via secure connection (SSL). The information will be stored on secure servers maintained by the “D.R.T.C., LLC,” its parent organization, its affiliates or by third parties that agree to use or disclose the information only to provide service to us or to comply with legal process.

7. Retention of the Information

We may retain the right to save any Audio or Video Recordings and Formal Complaints/Incident Reports you generate, along with any Registration and Geo-Location Information beyond thirty (30) days and for as long as necessary or required by court order or determined to be needed by the administrators of“D.R.T.C., LLC.” We may retain such information even if you disable or uninstall the App.

8. Your Privacy Rights, Choice and Access

If you provided us with Personal Information or Emergency Contacts through the App, you may review and update that information in Settings. In accordance with routine record keeping, we may delete certain records that contain Personal Information you have submitted through the App. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. It may not always be possible to completely remove or delete all of your information without some residual data beca

use of backups and other reasons. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

9. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy and our practices at any time. When we do, we will provide an update to the App with prominent notice of the new privacy policy, and will also post a notice at https://www.dopethemovement.comwith a link to the updated document. All Information collected after we have updated our Privacy Policy and practices will be governed by the updated document.

10. What This Policy Doesn’t Apply To

This Privacy Policy does not apply to any email communications to or from you, to your use of www.dopethemovent.com or other “D.R.T.C., LLC,”website(s) or those operated by our parent organization or affiliates, to your use of any other mobile applications, or to any information you provide or that we receive from any source other than the App.
